I have to submit a samename affidavit for purpose of getting duplicate share certificate. I am located in Bangalore. Here stamp duty applicable for affidavit is Rs 100. But the RTA of the Company is asking for affidavit on Rs 500 stamp paper as it Company is located in Mumbai and recently Maharastra stamp act was revised. So affidavit requires minimum Rs 500. Being in Bangalore, how can I execute an Affidavit on Rs 500 stamp paper?

Also, the name in physical shar certifcate and PAN are matching but it is different from Adhaar. But Adhaar and PAN are linked. So do we even need a smaename affidavit?

To solve this problem, can we execute the affidavit in five Rs 100 stamp paper each. Only 1 paper will have contents and rest will be blank. Will this be acceptable?

Stamp Duty Requirements 1. _Bangalore (Karnataka) Stamp Duty_: The stamp duty for an affidavit in Karnataka is ₹100.

 2. _Mumbai (Maharashtra) Stamp Duty_: The RTA is requiring a minimum of ₹500 stamp paper, as per the revised Maharashtra Stamp Act.

Executing Affidavit on ₹500 Stamp Paper in Bangalore To execute an affidavit on ₹500 stamp paper in Bangalore:

1. _Purchase ₹500 Stamp Paper_: You can purchase a ₹500 stamp paper from a licensed stamp vendor in Bangalore.

2. _Execute Affidavit_: Get the affidavit executed on the ₹500 stamp paper, ensuring it meets the requirements of the RTA. Alternative Solution: Using Multiple ₹100 Stamp Papers Using five ₹100 stamp papers, with only one containing the contents and the rest blank, is not a recommended solution:

1. _Invalid_: This approach may be considered invalid, as it doesn't meet the RTA's requirement of a single ₹500 stamp paper.

2. _Rejection_: The RTA may reject the affidavit, leading to further delays. Samename Affidavit Requirement Considering your name matches in the physical share certificate and PAN, but differs from Aadhaar (which is linked to PAN): 1. _RTA Requirements_: The RTA may still require a samename affidavit to verify the identity and ensure compliance with their procedures. 2. _Company's Policy_: It's possible that the company's policy requires a samename affidavit in such cases, regardless of the Aadhaar-PAN linking. To avoid any potential issues, it's best to: 1. _Execute Affidavit on ₹500 Stamp Paper_: Purchase a ₹500 stamp paper and execute the affidavit as required by the RTA. 2. _Consult with RTA or Company_: If you're unsure about the requirements, consult with the RTA or the company's representative to clarify their expectations.

RTA agreed for multiple Rs 100 stamp papers. But they did not reply to details on what to fill in the additional stamp paper. I have some doubts concerning this:

  1. RTA wants Notary to provide serial and book numbersin every affidavit. Notary charges Rs 500 for each affidavit. Now if I get 4 more additional affidavits (all dummy),  he will charge Rs 500 for each attestation.
  2. If there will be multiple book and serial numbers, then RTA will have difficulty in putting this information against single samename affidavit. So they might once again return back.

I would like to know as this is common problem, why Government did not think about this situation and provide some means of managing it. They can't expect us to go to Mumbai and catch hold of notary there and get things done. Whom should I escalate this matter to.

I would also like to know what is significance of Serial and Book Number which RTA insists to provide in every document? Is there any fixed rate for Notary services.

Do we have  special adhesive stamps or franking in Bangalore?  How to get this done? How to find out their availability?
