mr rahul ji please check it you wife made a FDR bank give the interest on that FDR and deduct the TDS

so for this file the return

According to section 139(1) a paerson has to file his return of income if his total income exceeds basic exemption Limit Therefore there is no need to file IT retuns.

Please also include the interest earned in FDR into the total income also. If after including the same, your income exceeds 190000, then you should file the return.

 

Also if the bank is deducting any TDS on interest on FD then to claim the refund also you have to file the return.

Here your wife having income below the exemption limit of  190000. So no need of filling return. But if If bank fd interest exceed 10000 bank will deduct tds and for claiming the same as refund you have to file return. Also that if you fill form 15g and submit it to the bank then bank will not deduct tds from your fd interest.

While it is true that she has no legal liability under IT act to file her return, it is better that a return is filed for the income offered. This will make it on record. Otherwise, when an enquiry comes for the source of deposits etc. u have to make a claim that she had such income, for which further proof may be called for. If u file return, the return alone would consitute good proof and cannot be denied by the authorities. Also it is better to bank the receipts on a month or week basis rater than once a year or so.
