if contract carriage contractor of a bus opreator being not charge in their bill service tax due to lake of knowledge from past 2 years now company start bill with written without abatement then opreator is liable for pay tax past year or what 's the process for to minimum penal?
As per my understanding, you are a carriage contractor with a company and have not paid Service Tax for the past period. Now the company with which you have a contract wants you to charge the amount by way of a Bill alongwith Service Tax. Since, you have not charged and paid Service Tax from last two years you want to know what is the minimum penalty for the past two years if you start paying Service Tax now.
In this case, Service Tax can be deposited alongwith interest for th past period by calculating the cum-tax value menthod. With respect to penalty for the past period, specific period is to be mentioned so as to see the relevant provisions of penalty existing during such period.

notification no.25/2012 dt 20/06/2012 point no. 23b
the liability starts from the day company gets its service tax registration no Failing which penalty is applicable as per norms laid down in the act.
