Service tax reversal case

We are private limited company in mumbai. we have booked an invoice in our accounts in april 2014 for giving customisation services to our customer and paid rs.35000 service tax on it. now we have cancelled the said invoice fully in march 2015. We will rebook this invoice in april 2015 with revised invoice amount. customer has made us part payment against the said invoice in May 2015 (paid 30% of total invoice). Now can i take input credit of cancelled invoice in march 2015. can i claim full Rs.35000 credit while making payment for March 2015 of service tax.

Hi,

If you have raised an invoice or received any payment and Service tax is paid thereon and if the said service is not so provided or completed either wholly of partially later on, credit of service tax paid is allowed under Rule 6(3).

Therefore when you cancel the invoice in the month of March , you can take the credit of excess service tax paid under Rule 6(3).
