I had applied for service Tax registration in Jan 2012, however I got my registration number on 9th April 2012. Now I am not able to file service tax return for half year ended 31st March 2012 as it is saying that you cannot file return for the period prior to registration date.
Kindly suggest me what need to be done. Whether liability of non filing of return can be initiated by department against me?
Liability of non filing of return cannot be initiated by department even if you have collected the service tax and paid the service tax to the department. You can inform them formally in writing about this mentioning the amount of service tax paid and reason for non-filing of the return.
It would have been better if you had written to concerrned Asst comm before the due date of filing of returns, any ways it still fine.
