Service tax - proprietorship

Queries 322 views 1 replies

I am a businessman having a proprietorship firm. I had already taken a service tax number for this firm.

I have an office space in my personal name. I lent it to some person.

Someone told me that i have to pay service tax on that rent bcoz i have a service tax number. and service tax number is alloted to a person not to proprietorship firm. So person and firm are the same assessee.

Shall i required to pay service tax or not ?

Dear Prateek,

Proprietorship business and Proprietor both constitute as single person. Further in proprietorship registration PAN No is also used of the owner no separate status.

However, it is not a bare condition that you are having service tax number you have to pay service tax.

You are liable to pay service tax only in case you have Annual turnover of taxable services more than 10 Lac.

However you have to file timely service tax returns with claiming exemption under notification no. 33/2012
