Service tax on under-construction house purchase in maharash

Hi All,

I am purchasing a flat in a new building under construction in an existing society, in Pune. The builder is insisting on a registration after payment of some minimum amount. I am incurring service tax on the same.

I would like to know what is the way in which this service tax can be avoided. Also, are there any implications of an early registration other than service tax.

Service provider by builder to buyers of flat is liable to service tax. There is no way to avoid that.

I was under the impression that service tax is only for under-construction flats and that it is not applied if the completion certificate has been obtained. Could you please clarify if my understanding is correct?

My query is on the same front. I have purchase a flat in Pune Maharashtra in one of the grampanchayat area, registered amount is 15,91650 and registration date is 04-08-2011 and I am getting possession of it on Dec-2012. Builder has taken 1% as a VAT alongwith intrest of 15% on 25th Aug 2012 through cheque and I will have to pay service Tax before possession I mean before Dec-2012. I s this correct or what % of VAT and service Tax i should pay? Please clarify..... This might helps lot of buyers in different locations.
