Service tax on insurance commission

201 views 2 replies
My wife is a life advisor in a private insurance company.company deducts 10% Income tax and 10%service tax at source from her monthly commission earned. My query is, can she claim back the service tax paid like the IT deducted at source?

service tax subject to pay by service provide not by insurance agent

FIRST PLEASE CHECK SERVICE TAX DEDUCT 10% , BECAUSE SERVICE TAX RATE IS 14.5% NOW OR 14 AND 12.36 %  EARLIER.

IF YOUR WIFE IS AN  SALARY BASEIS EMPLOYEE OF PRIVATE COMPANY  ,SO COMPANY SHOULD NOT DEDUCTE SERVICE TAX , BUT IF YOUR WIFE ONLY  A COMMISSSION AGENT AND NOT GET MONTHLY SALARY , THAN THE COMPANY MAY BE DEDUCTE SERVICE TAX

THANKS
