Service tax on gta
There is a partnership firm. ,....whose audit i am doing....
That form is not paying Service tax on GTA....& when i ask them why not u r paying ..they tell that there is a disputed matter going in kerela high court ....i want to know is there is something like tht

It doesn't matter if some litigation relating to some other assessee is pending with the high court. The partnership firm should take service tax registration and pay tax on Freight paid to GTA under RCM. However, if the goods being transported is exempted vide NN 25/2012, then no need to pay tax.
