Service tax input on brokerage for rented premise

Hi,

We are paying commission to a broker for taking a rented premise; the broker has invoiced us and charged service tax on the same. Being an software and software support company, can we tk service tax input on the same????

Yes, Ankit. If the input service is used for providing taxable output service then cenvat credit of service tax can be availed and utilised. Also, commission is not explicitly mentioned in the exclusions to the definition of input service provided in Rule 2(l) of CCr 2004 as amended.
