09 September 2015we are fabrication & Erection contractors we are utilizing the crane of the company provided by the third party and the party is producing the bill to the company for crane hire charges, and the company is charging the debit of crane utilization along with service tax to us, can we take credit of service tax charged by the co. Pls do the needful.

to get entitled for credit, you have to get the invoice in your name and then you can bill the same to the party . but no diff indeed
as the services of crane is used by the the client himself, it would come to your hand and you will charge the same to him again, however to get credit u need to have bills drawan in your name direct from the service provider.
