Service tax for transport company

Hi,

We have Incorporated a Private Limited Company recently with a clear objective to run " Goods Carrier Business" with a pool of TATA Trucks and in future to by few cars and run TATA Taxi Cab service.

 

Please advice whether we need to registered with office of Central Excise & Service Tax In our district.

Also I was told that the Goods Carrier Business is Exempted from Service Tax Recently. Can any one clarify on this matter.

PLEASE TELL ME HOW PERCENT ABATEMENT AVAILABLE FOR TRANSPORT BY ROAD UNDER SERVICE TAX  AS ASSESSEE IS A SERVICE RECIVER OF TRANSPORTER COMPANY AND ALSO GIVE LINK OF NOTIFICATION OF NOTIFICATION. OR MAIL NOTIFICATION TO asif.del @ haikologistics.com.

The GTA business has to be seen in the following aspects :-

Negative list- The Transport of goods by road is exempt except by the Goods transport agency and courier agency so your service is taxable.

Reverse charge and Abatment- The abatment of 75% is available and reverse charge is applicable  if the following conditions are satisfied

  Services provided or agreed to be provided by a goods transport agency in respect of transportation of goods by road, where the person liable to pay freight is,-

(a) any factory registered under or governed by the Factories Act, 1948 (63 of 1948);

(b) any society registered under the Societies Registration Act, 1860 (21 of 1860) or under any other law for the time being in force in any part of India;

(c) any co-operative society established by or under any law;

(d) any dealer of excisable goods, who is registered under the Central Excise Act, 1944 (1 of 1944) or the rules made thereunder;

(e) any body corporate established, by or under any law; or

(f) any partnership firm whether registered or not under any law including association of persons;
