Service tax credit as cenvat

Sir,

  We are manufacturer having central excise & service tax registration (GTA & maintanance or repair services).

What credits are eligible to avil service tax credits as cenvat credit.

DEfnition of input service is shown below. Any service that falls within the scope of this defnition qualifies for cenvat credit.

"input service" means any service,-

 

(i)

used by a provider of taxable service for providing an output service; or

 

(ii)

used by the manufacturer, whether directly or indirectly, in or in relation to the manufacture of final products and clearance of final products upto the place of removal,

 

and includes services used in relation to modernization, renovation or repairs of a factory, premises of provider of output service or an office relating to such factory or premises, advertisement or sales promotion, market research, storage upto the place of removal, procurement of inputs, activities relating to business, such as accounting, auditing, financing, recruitment and quality control, coaching and training, computer networking, credit rating, share registry, and security, inward transportation of inputs or capital goods and outward transportation upto the place of removal;

please advice me on service tax in case of restaurent with A/c and liquor licence

1. is sevice tax applicable on service charges charged by the restaurent.

2. Is service charge applicable on list price or on price taken after giving  discount

3. If we can take input of service charge paid on rent for the restaurent premises.

1. Any service provided by such restaurant is liable to tax.

2. After discount.

3.If you avail abatement of 70%, service tax on rent is inadmissible credit . Otherwise credit is valid.
