Service Tax cenvat credit

Queries 2047 views 6 replies

I am working in a multinational co. engaged in trading activities and I want to get service tax registration. However no liability comes in near future since amount comes from serivice of electrical/electronic items is less than 10 lacs limits but I want to carry forward cenvat credit which I am paying service tax on various type of bills (consultant/advocate bills, contractor bills, telephone bills etc.). Can I get cenvat on whole service tax on above bills or in some percentage because all the bills are not related wholesole with the service doing iteself. Can I carry forward this service tax to next financial years so that when I shall have to pay service tax, I could adjust this service tax against cenvat? Pls. also suggest should I get registration or not.

No. As long as you are taking exemption, you are not eligible for cenvat credit. When you start paying service tax, you will be eligible for cenvat credit on inputs/input services.

Mr. Anoop I will saying to you that taking registration in service tax because not apply in your service tax but will be sure ITC adjustment.

Thanks.

We are a Exportor of Services to outside India. We have taken Service tax Registration. We have paid Service Tax charged on us by our vendors. I want to know Can we take Refund of the service tax paid to our vendors. If yes, then what's the procedure for the same.

I have file E-Return of Service, if answer to the above is in affirmative then in ST-3 where I have to show such figure so that I can take the refund of the same or if there is any other way to claim the refund of service tax.

Please help me.

Thanks,

Gurmeet

You can claim refund of service tax under otification 41/2007
