06 December 2015Dear Experts, Can you please help me with the awnser for the below mentioned query:
Mr. A is having a beauty salon business and his turnover is 5 lacs P.A. Further, Mr. A is also a partner in a partnership firm with Mr. B running another beauty salon (Mr. A: 70% and Mr. B: 30% profilt sharing). The turnover is of the partnership firm is 6 Lacs. Now whether Mr. A individually or the partnership firm is mandatorily required to register under service tax ??

Partnership and indiviudal are different persons and have got different PAN no. As long as there is purposeful breaking up service provided to avoid the ST, the exemption is available for both the partnership and individual separately.
