Service tax and income tax

I have recently provided consultancy services to a company in my part time and the gross earnings were 3.2 Lacs in the last financial year. This company has deducted service tax( @ 12.36%) at source and has not provided me with a service tax regn no. In addition they have also deducted TDS @ 10% and given me the balance.

Do I pay service tax and Income tax together. I have paid almost double my actual liability.

Kindly give me your expert opinion.

You are exempt from service tax due to reason your gross liability to earn not exceeding Rs. 10 lakh and in this case entire liability to be paid service tax only service receiver for example.

(You raised the professional invoice Rs. 100.00 @ 12.36 (Ser. Tax) i.e. Rs. 12.36 recipient liability only).

And further TDS procedure is rightly way. May be you can claim REFUND amount which is deducted @ 10% and asked the service tax amount @ 12.36%, which is provide such service by you.

deduction of tds is correct but service tax should not have been deducted by co. because you are not liable for any service tax as your receipts from services is less than 10 lakhs.
