Service tax

Dear Sir,

We have received only 25% of the bill amount from the party and we would like to know that service tax pzyment would be done on full bill amount or 25% of the bill amount received by us.

After the applicability of Point of Taxation Rules 2011, the service tax will be charged on 100% bill amount even though you received 25%. Before POT Rules, in your case, only 25% would have been charged to service tax!

Since 01-04-2011 after introduction of Point of Taxation Rules , bill amoun tis liable to tax irrespective of payment received.

i want to know below points for  service tax (GTA)..

1) in the case of GTA payemnt who is liable for S.T payment either Consignor or Consignee?

2) we are consignor - A) Mtrl. dispatch on To Pay Basis

B) Mtrl. dipach & Freight we have to paid

C) we have paid full amount with S.T but transpoerter will not mention / not a click the S.T payment liablility (whose the pay the S.T) on LR copy then who is liable for S.T payment

4) same for when we are the consignee (Purchaser) in this case we are paying the Payment to transporter so who is liable for S.T Payment?

5) can we adjust Output (Utilized) S.T Cr. @ Input Cr. in case of GTA?

6) also can we adjust Input cr. against excise payment when we are liable for PLA?
