No. You can't claim expenditure on Capital Asset (Eg - Building, Machinery etc) u/s 35E for which Depreciation is allowed u/s 32.
I am not sure on 2nd part of your Question. But i think it's an advantage given to assessee to claim deduction for the expenditure incurred. If you claim, you will get it otherwise not.
