Section 186

For the purpose of Section 186 of Companies Act 2013, Rule 13 provides that it would be sufficient compliance if special resolution is passed within one year from date of notification of this section ( i.e. till 31.03.2015). Can this gestation period be presumed to be available for Public Limited Companies as well? Or is it available only to Private Limited Companies? 

 

Section 186 of the Act is applicable for both private and public complanies, hence the explanation to Rule 13, is applicable accordingly.
