Dear All

We have recd notice under scrutiny of A.Y. 2009-10. We have provided all detail regarding for assessment to our CA. now our CA is saying that your case will be Ex – Party please let me know what is Ex-Party and what are the penalty if our case goes for Ex-Party

Ex-parte assessment involves computation of income and tax thereon by the AO(Assessing Officer) to the best of his judgement and from the information supplied by you to the department.. The possible reason of Ex-parte assessment is that you have not complied with the notice of AO..

Ex-parte is decision to be taken to the best judgement of the A.O. without you as you might not have complied with the assessment order and subsequent requirements

Sir-If your furnishing is correct Your CA might not submit the details to your AO at the time of hrg or he had not attended IR hrg at all. 

 

The option to you are:

01 Call on AO directly - none can ask you/bar you to appear before him..  While going to Income Tax office go with your original PAN card or Deed of partnership to prove your identity and inform to AO the happenings    

 

Exparti order cannot be made when the details are furnished to AO  At thebest he can reject it

Hence check your CA

 

02 can file Appeal before CIT {A} and there is every chance to win over.
