SALES TO SWIGGY TAXABLE OR NOT

Dear experts

Will an e-commerce operator be liable to pay tax in respect of supply of goods or services made through it, instead of actual supplier? E-commerce operator is Swiggy and supplier- Resturant

TCS Deducted by the E-coomerce operator can be set-off against liability .

1. E-commerce operator is not liable be pay any GST on goods supplied by supplier on his behalf.
2. Yes the supplier can claim TCS -GST deducted by e-commerce operator , as it's reflected in supplier's portal under Tab TDS/TCS . & filing the same by Supplier it gets reflected in its Cash Ledger & supplier can pay off his tax liability from the same .

(Can also claim refund from cash ledger)
Please Refer Sub-Section 5 of Section 9 of CGST ACT, 2017.
