Salary earned outside india - tax implications

Tax queries 230 views 4 replies

Dear Expert's,

A person earns salary income outside India & accordingly receive the same in the Bank account maintained outside India.

He goes outside India only for employment purpose.

Further he stayed in India for less than 182 days in PY.

Whatever salary so received was transferred by him in NRE account maintained with Indian Bank.

My question is

Whether his salary income is taxed in India or not?

Please clarify the above issue.

Regards

Being NRI status, his salary income not earned/accrued in India is not taxable in India.

If your status is ‘resident,’ your global income is taxable in India. If your status is ‘NRI,’ your income which is earned or accrued in India is taxable in India

In my case I was away from India since 18Nov2012 to 04Oct2018. I came to India on 5Oct2018.  I have joined a job in India from 15Oct 2018.  Am I supposed to pay tax on the income earned and received outside India for the period from 01Apr 2018 to 04Oct 2018? My stay in india in the previous year 2018-19 is 180 days and 19hrs including my visit days to India.

1. Hours are not taken in to accouting but stamping dates on your passport.

2. Being not completed 182 days stay, your status remains NRI, [based on assumption not stayed 365 days or more in preceeding 4 years.

3. Thus only salary earned in India will be taxed, and not that earned outside India.
