RNOR tax status - services to foreign company with no Indian connection

Tax queries 229 views 2 replies

I am Indian citizen that returned to india after 10 years of stay in USA. I qualify for RNON status thus came to know that my foreign income is not taxed in India.

  1. My employer wants me to provide consulting services even after my return back to India. (software toubleshooting/maintenance services)
  2. My employer/client has no presence in India.

ARTICLE 15 Independent Personal Services

1. Income derived by a person who is an individual or firm of individuals (other than a company) who is a resident of a Contracting State from, the performance in the other Contracting State of professional services or other independent activities of a similar character shall be taxable only in the first-mentioned State except in the following circumstances when such income may also be taxed in the other Contracting State: (a) if such person has a fixed base regularly available to him in the other Contracting State for the purpose of performing his activities; in that case, only so much of the income as is attributable to that fixed base may be taxed in that other State; or (b) if the person's stay in the other Contracting State is for a period or periods amounting to or exceeding in the aggregate 90 days in the relevant taxable year. 2. The term “professional services” includes independent scientific, literary, artistic, educational or teaching activities as well as the independent activities of physicians, surgeons, lawyers, engineers, architects, dentists and accountants.

My questions:

The india-USA DTA seems to suggest i cant be taxed in USA as i am resident of India for tax purposes. Am i interpreting this right ?

If i earn income by independent cosulting for my US clients will i as an RNOR be taxed on that income in India.?

Seems tooo good tbe true but just checking ..... :) i alredy consulted with our CA in India and he has no clue.

thank you,

"I alredy consulted with our CA in India and he has no clue." I disagree.

He may not be practising taxation, particularly Direct taxes, but that doesn't qualify everyone. Better consult an experieced one having some International taxation knowledge. Sorry, if hurted.

Suggest you to ask the query in expert section. (CCI)

Np sir .. that is waht i meant. He is not experinced with international taxation.
