One of my friend had completed 19months of Articleship training. And after which he need leave for the preparation of examination but his principal is not giving him leave and he is also saying that "Jo karna ho karlo, jaake ICAI main complaint kar sakte ho to woh bhi kar do". What was the right of articles against their principals. In case if principal is not giving leave for the preparation of examination and Termination also. Can anyone tell me.

aray yaar so simple,
he can take termination from the firm & can join another firm or As per icai rule if he has not taken any leave in those 19 months then he can take I think around 45 days of leave which the principle is bound to give. by the way can i know that he is a PCC student or final student.

For examination purpose an article asistant has right for leave.Leave is granted as 1/6th of period actually served or 2 months which ever is lower in your case 2 months is your aslute right you can also negotiate for more leave.....................an article assistant is also enetitle leave for IT trainning and his will not be treated as leave......................
you can also refer training guide provided by institute ....................
Take form 109 take a transfer and go to some new firm.
ur frnd can take termination from such auditor he will face no problem
