I AM SHOPKEEPER. I HVE RECD A ASSESSMNT ORDER FOR CLAIMING MORE PURCHASE TAX INPUTS. NOW I HAVE ALL THE BILLS TO SHOW THAT I AM NOT CLAIMING WHAT I HAVE NOT PURCHASED. IT SEEMS THE SELLERS HAVE NOT SHOWN THEIR SALE. I ALSO WANT TO MAKE A REVISE RETURN FOR THAT PERIOD AS I  HAVE NOT SHOWN ONE OF THE PURCHASED BILLS.

CAN I MAKE A REVISED RETURN AFTER RECIEVING THE ASSESSMENT ORDER...PL.SOMEBODY FROM YOUR ESTEEMED CLUB HELP?

  Ms Suchitra,

Even though an assessment order has been issued, which is wrong as you say,you can file a revised return for the same period. Before issuing an assessment order the authorities should have issued a notice to you calling for a reply. Have they done it.......MJK

oh yes they did ....but i missed the dates...which was 19 oct...now what i have to do ..I have all the bills with me...any form to be filled...

Ms Suchitra,

In fact, the assessing officers should first catch hold of the seller for having committed an offence of not filing proper returns as per their books of a/c. If such selling dealer is missing/closed down his business, then they may come to you with a notice to make good any loss of revenue. Here you can object to their order passed without giving an opportunity to be heard. Some times the department officials do both the actions. They punish the seller for not declaring some sales in their returns and also the buyer for claiming input on bills which were not declared by the seller and paid taxes. This is wrong. Once they tackle the seller the purchaser should not be troubled, because you have not any thing wrong........MJK

Thank Mr. Krishnamurthy.  But the question is how do I proceed now..what is the procedure to object
