One of the vendors (an individual) is providing AMC services in realtion to maintenance of boiler. The agreement with the said vendor states that "All materials and tools need to be provided by us and any excess/unused materials shall be returned"
In a nutshell, it is service only contract and no material is provided by vendor. Whether service tax under RCM has to be paid by us or not??

yes. it is covered under RCM, it is irrelavant that whether vendor supplying material or not, he is providing services and he is individual hence coveres under RCM
