Return not filed by service provider
If one company has paid for some service to service provider and had deducted and Deposited TDS on time but service provider has not filed their Income tax return for that period. Can on this basis the assessing officer can disallow the expenses of the company

No sir. The deductor company's duty is to deduct TDS as required under concerned section.
That duty is complied with. There is no question of it's disallowance in the return of a TDS deductor company.
