Return not filed

Hello

Assessee has not filed the return for F.Y. 2010-11 which is now time-barred as per Income Tax Law. But there is a good amount of TDS deducted for that year. Assessee not being aware about the laws and rules did not do anything at that time. Now he wants to claim that amount. Can it be claimed? Is there any way through which it can be processed and refund can be claimed?

Yes you can file return. Normally such a return will be treated as Return Non Est ( i.e As if it were never filed). But you can make an application to the IT Authorities ( Depending on Quantum of refund - Commissioner/Chief Commissioner/CBDT). If you can show a genuine and valid cause why return was not filed in time, then there is a chance that the refund may be allowed. But it is purely discretionary n the part of the authiroties concerned and no appeal etc will lie against any refusal to issue refund
