Residential status practical query

Others 596 views 2 replies

Say a person was in India for 162 days during the P.Y. 2011-12, hence his residential status for the year is:Resident in the A.Y.2012-13. Now, this person was a non-resident for 2 years consecutively in the 10 years immediately preceding the P.Y. 2011-12. So, what would be his residential status in the A.Y. 2012-13? Resident and Ordinarily Resident OR Resident and Not Ordinarily Resident and why[Reasons]?

As u said person is in India for 162 days in previous year 2011-2012 So he can't be a resident of India at first for A.y 2012-2013. As conditions to be resident are 1) A person has been in India for atleast 182 days during P.Y or 2) has been in INDIA For atleast 365 days in P.Y and has been in India for atleas 60 days during P.Y
