Residential status for visiting NRI

My relative is green card holder since July 2020 and stayed in USA for 272 days in FY 2020-21, thereby became NRI for AY 2021-22.  He visited India on 8th April 2021. 

Kindly advise how many days he  may stay in India during the FY 2021-22 ( AY 2022-23) without loosing his  NRI status if (i) his total income during the FY 2021-22 would be over 15 lacs in india  ( other than foreign source ) and

(ii) he is  US tax payer paying taxes on Rental income in USA .

A person would be a RESIDENT of India for income  tax purposes if-

He/She is in India for 182 days or more during the financial year.

OR

  • If he/she is in India for at least 365 days during the 4 years preceding that year AND at least 60 days in that year
  • safely upto 05.10.21
  • days he may stay in India during the FY 2021-22 ( AY 2022-23) without loosing his NRI status if (i) his total income during the FY 2021-22 would be over 15
