if a person staying out of india from 2016 and every year stays in india for 20 days (from 2016 to 2021) and in fy 20-21 needs to sell site in india and want to apply for tds lower deduction.
my question is since he is not in india for 182days, or 60 days in previous year nor 365 days out of 4 years. so he is not a resident of india.
but to apply for TDs Lower deduction ready to stay in india during fy 2021-22 for 182 days, if he stays 182 days is he becomes a resident of india?. and can apply for TDS lower deduction.

Non resident too can apply for lower deduction.

If he stays 182 days in 2021-22, application for TDS lower deduction not required right sir, since he become a resident of India and TDS attracts 10%.
