Resident & Non Resident Querry

Dear all

Can you tell any body please, If one person is Non Resident, but every 3 months that person visited mother country i.e. India.  But that person having another country Resident visa.  According to Income Tax Act, that person belongs to under the category of the Non Resident or not?  I will be thankful, if any body give reply. One more information during the person visit duration irrespective period accumulate the days is total 72 days only

Ya duration of his stay in India is relevant for determing the residential status.

he is a non resident bacause his stay in last year would not be atleast for 182 days (person of indian origin or for person leaving india for employment purpose) thereforenon resident

I will suggest you to read Section 6 of Income Tax Act 1961 .....that will clear all of your doubts
