Hi,

I am a marine engineer working with a U S based company. I sustained an injury while working on the ship. Due to this , I will be unable to achieve the "Non Resident Status" in this financial year.

My employer has been paying disbality benefits in addition to my medical treatment expenses. Is the disability benefit subject to taxation in India?

My employer has not paid any taxes on my behalf in the U S. Also are there any exemptions or relief that i can avail?

I have filed my taxes for the last financial year.

Mr Nithin,

 The disability Benefit is taxable under head Salary.

However , You can claim deduction u/s 80U (50,000 or 75,000) if your disability is covered by the said section.

Get  well soon.

 

 

 

Sec 6 is silent in this regard.It means ur all income is taxable in INDIA. However u can claim deduction U/S 80U subject to conditions r given in that Sec.
