Requirement of cs and kmp

If a company is a private limited company and incorporated in may 2013. If its paid capital was increased above Rupees Five Crores on 06/02/2014. As the requirement of paid up capital for appointment of KMP as per compaines act 2013 is increased from Rupees Five Crores to Rupees Ten Crores from 01/04/2014. So I have a doubt whether the company has to appoint a company secretary and managing director although the limit of paid up capital increased to Rupees Ten Crores from 01/04/2014.

Hello Mr. RAja,

Section 203 of the companies act 2013 dealing with KMP is not applicable to private limited company. and hence ur company is not required to appoint a CS and a managing director.

But the question is that the paid capital was increased before 1st April 2014 above Rs. 5 crores and as per companies act, 1956 we have to appoint company secretary in whole time employment as per section 383 A  if the paid up capital of the company increased above Rs. 5 Crores.
