Requirement of changes in object clause

Dear friends please clarify my doubt

If a company in its object Clause of   Memorandum of Association has mentioned scope of activities under three types of activities 1. Main Objects 2. Anciliary / Incidental activities for attaining main objects and 3. Other Activies.

 

Under main objects, it has been mentioned to do business of Constructions and Real Estate, while under the head Other Activities(3rd Category), business of retail trading or any other type of dealership is mentioned.

Since incorporation the company has been doing real estate business, now the company is investing in FMCG goods trading business.

Is it required to amend the object Clause to include trading activities under Main Objects?

As per my understanding your main business are dealt with real estate. If you want to carry on business of FMCG good along with real estate then it is not permissible. It is covered under two different head of NIC 2004. The MCA will object on such business.
