Registration by gta under gst

Sir,

We are a good transport agency, but we do not own any single truck or fleet. We take trucks from their owners and pay charges to them. We raise bill to our parties which are already registered under GST. We clearly mentin on our invoice that GST will be paid on RCM basis by our clients. Except this, we are not supplying any service, although we are registered under GST, now my question is whether we need to register under GST or we have to cancel our registration as per notification no. 5/2017 of CGST Act. Seondary if we are liable to register under GST then whether we have to pay GST on payment made to truck owners or not. Please reply. Thanks in advance.

First GTA service provider is not necessary to registered himself in GST. 2nd if a GTA take service from another GTA then it is exempt service.
GST is levied on supply of goods or services, so if you want to pay you need to charge from customers @ 12% & 18%. So, that customer get input and you can also sale on RCM invoice. There is no need of registration for GTA. Here truck owners are service provider for you.
If you issue Bilty or consignment Note???
Consignment note and builty are the requirement of having GTA.

We are issuing builty with invoice to our clients.

No need to pay tax on payment made to Truck Owners.
