Please guide about the Provision of registered office of a New Company, in INC 7 we have to mention that "Weather the corrospondence address of the company is same as registered" if we select yes option then we have to file INC 22 with INC 7. For filing of INC 22, a case where the Registered Office is taken on lease by company, what document have to attached for proof of registered office.
Weather the company can make agreement with land lord of R.O before incorporation?
Attachments for INC - 22, if Property is taken on lease :-
1. Rent Aggrement
2. NOC from landlord ( to use the property as a registered office for a company )
3. Electricity Bill not older than 2 months
Thanks Sahil for your immediate response, but my question is whether a company makes an agreement before its incorporation because for rent agreement there is a contract between land lord and company and I think before incorporation all act of company in not a valid in nature.
Your point is also correct, see I am not sure but what we can do is
Any one of the director can enter into the rent agreement
and you can select "Owned by director(Not taken on lease by company)" in INC - 22
and then director will give NOC to Company
Yes the promoters of the company can enter into an agreement with the landlord for taking the office on rent. the words to metion will be agreement will be between "Mr. A, the promoter of the proposed company""..............Pvt Ltd (Company yet to be incorporated) AND Mr. B, the landlord"
