Regarding termination of articles after 1 year under a CA.

I have completed 1.5 years of my articleship period. But I wanted to change to any other firm and I do not come under any of the conditions stated by ICAI for termination of articleship. I already have health issues and now I am having a mental pressure in the firm I am currently working in. I wanted to leave this firm in any means. Because of this firm I am struggling mentally and it's affecting my studies and my future. And I sincerely don't want to continue in this firm anymore. can you please help me with this problem.

Dear Devigaa, Thank you for sharing your situation. You're not alone—many CA students go through similar stress during articleship. Let's look at your options practically and within ICAI guidelines. --- ## 🎯 **Your Goal** You want to **terminate your articleship after 1.5 years** and **shift to another firm**, but **don’t fall under the standard ICAI rules** for termination after 1 year. --- ## ✅ **ICAI Rules for Articleship Termination After 1 Year** According to ICAI guidelines, termination after 1 year is permitted only under **specific conditions**, such as: 1. **Transfer of parent/guardian** (if dependent). 2. **Serious medical grounds** (requires medical certificate). 3. **Marriage** (for female candidates). 4. **Other circumstances** with Regional Office approval. --- ## 🌟 **Your Case: Mental & Physical Health Issues** You **do mention health and mental stress**. That gives you a potential path forward. ### 📌 **What You Can Do:** ### Option 1: **Termination on Medical Grounds** * **Prepare medical documentation**: * Get a **certificate from a registered doctor** (preferably a specialist) stating: * The nature of your health issue(s) * Impact on your daily functioning and studies * Recommendation for a **change in work environment** * Write a **detailed letter to ICAI** (Regional Office), explaining: * The mental pressure you’re facing * How it’s affecting your health and studies * That you're not requesting to discontinue CA—just to change firms for your well-being 📍 ICAI has been known to **allow termination on genuine medical/mental health grounds**, even if not explicitly mentioned in standard conditions. --- ### Option 2: **Mutual Termination with Principal’s Cooperation** If your **current Principal is cooperative**, you can: * Submit **Form 109** for termination * Mention “Mutual Consent – Health Issues” (or similar) in the remarks * It still requires ICAI approval **after 1 year**, but a **genuine, supported request often gets accepted** --- ### Option 3: **Reach Out to ICAI with a Personal Request** If the Principal is not supportive, and your issue is serious: * Write directly to your **ICAI Regional Office** or use the **SMP (Self-Service Portal)** * Attach medical records and request a **one-time approval** for transfer * Mention that it’s essential for your **mental well-being and academic performance** --- ## 🛠 Suggested Steps Right Now: 1. **Visit a doctor** (preferably a psychiatrist or clinical psychologist) and get a medical certificate. 2. Draft a **formal letter to ICAI**, including: * Your details (name, reg. no., firm name, etc.) * A request for termination * A brief explanation of your health and mental pressure 3. **Submit Form 109** once approval is granted. --- ## 💬 Final Advice * Don’t continue to suffer silently. ICAI does consider health issues seriously. * If needed, speak to a **trusted senior, CA mentor, or counselor**. * Keep all communication with ICAI **professional and polite**—they are more responsive when approached respectfully and with documentation. --- Would you like a **sample draft letter** to ICAI for medical-based termination? I can prepare one for you. Stay strong—you have every right to protect your mental and physical health while pursuing your CA journey.
