Hello Friends, I am presently working in a small company of less than 10 employees which pays me salary directly without deducting the TDS or any other taxes. The company is llc and not pvt ltd. My this year salary is 3 lacs. I wanted to file the ITR return for present year and for that I asked for Form 16 from the employer. But the company CA informed that in your case only Salary certificate will be enough on companys letter pad. Form 16 cannot be issued in your case as TDS is not deducted and the company is not Pvt Ltd. I would like to know wether what he says is true or false? Is it possible to file the ITR return only with Salary certificate as proof without Form 16?

Yes Darshak you can file your ITR based on Salary Slip or Salary Cerficate .

if any other income (if any) earned during the year, have to include in your return

Also, I wanted to know is there are specific format in which the employer should issue Salary certificate for ITR filing or can you please mention what should be the necessary details mentioned in issued salary certificate?
Dear Darshak, there is no specified format for salary certificate.It may vary from company to company but normally it issued in the organisations letter head describing the salary you have received for a perticular period(for the period you have worked) and is signed by the authorized authority.And that will be enough for you to file your ITR.
If income only from salary then form 16 is enough

One more things the salary Cerficate must be in deatil with all componets of salary .
Yes you can file the ITR and if there is tax applicable you can that sepreatley as self assessment tax
