Regarding Availabilty of input credit

Give me a solution for this case.

service        10000
service tax     1224
total            11224

They are paying 10000 and paying service tax to the department in our name

            We are paying service tax to some of the service be avail.
                   Example : Telephone, Audit fee

In order to avail the input credit whether it is necessary that we should collect service tax.

See in this case can we avail refund, since the service tax is paid in our name without availing input credit.
