Regarding apply of TAN

Hi, I have a startup company. I want to give form 16 to all my employees. For that should I apply for TAN? Can I issue form 16 without TAN number? None of my employees will get attract TDS, so even after applying for TAN number, I wont be depositing tds to the government..

Please someone enlighten me in this issue

You can give Salary Certificate to your employees, when no TDS deducted (deductible) from salary.

But while generating the form 16, it is showing we can't generate form 16, please enter the TAN number

You cannot generate form 16, when no tax paid or no TDS return filed.

You can give only salary certificate for 12 months, so that employee can provide it as proof of salary received in particular FY.

So by taking salary certificate into consideration, can we file the ITR for the employees??

Yes. Based on the certificate, an assessee can file ITR. (provided the gross salary is below Basic Exemption limit)

But if Gross salary is above BEL, the employee has to file TDS return (even if net taxable amount be below maximum amount not chargeable to tax)
