Eligibility to claim 80GG

person has actually paid rent to the Tennant

Who are not availed hra benefits which is given by the company

rent received from another house treated as income from house property

1. Sec 80GG puts restriction only to not own a residential accommodation in the place of occupation. The two proviso u/s 80GG is only in relation to more than one self-occupied property and does not include one house owned by the assessee.
2. If you have actually paid rent then deduction u/s 80GG can be claimed lower of the following,
i) Rs. 5,000 pm or
ii) Rent paid less 10% of adjusted total income or
iii) 25% of adjusted total income
Whichever is less.
Please correct me if the above interpretation has an alternative view.

Hi,

As long as the place of occupation is different from place of residence from which you're claiming Income from House property, it shouldn't be an issue.

However, to claim deduction u/s 80GG, you are not supposed to receive HRA Benefit from your employer and the rent is actually paid by the penant other than cash.

Thank you.

if you are not in receipt of hra, you can claim 80gg deductions and I concur with Mr Suresh view
thank you everyone for your information
