Quick Summary
This discussion clarifies whether an appeal can be filed against an order even if a rectification application for the same order is pending. The consensus is that you can pursue both options simultaneously. If an appeal is filed, the tax officer will typically proceed based on the appeal's status. The outcome of the appeal will determine how the original order is handled, potentially involving interest and penalties if the department wins.

Yes, Appeal can be file against order.
It means I can opt both the option at the same time. my rectification application is pending before the tax officer against the order issued by him and I can also file appeal for the same issue before appellate authority. Am I correct?
Yes, If You file appeal then T/O also deal based on appeal.

The rectification application is pending and also will be file appeal.

In this follow up,

If we will going through appeal then the order is just stop/wait for collecting payments by dept.

In case Appeal is favour to taxpayer then the order will be close by AO.

In case Appeal is favour to Dept then Order will be force by AO with interest and penalty...

Do not post fictitious statement go by sec.
