A new company is registered in the same name which is already registered. my question is:----
1. whether or not second registered company can go for suo-motto rectification under section 22 of the companies Act, 1956.
2. if yes, there is any time limit for moving the application by such company.
yes the company can go for suo motu change of name by passing an ordinary resolution and prior approval of the CG.....
as far as the time limit is concerned...there is no time limit fr suo motu rectification....but CG can give direction within 12 months of incorporation of company and the company has to abide by it within 3 years of direction by CG....
