Dear All, Kindly tell me the Rules regarding Full Reverse Charge Mechanism. If the service provider is a insurance company or GTA & is a Registered body or a Corporate and the service receiver is also a Corporate then who is liable for Service Tax Liab under RCM.

Kindly provide the link or file for FULL RCM Liability...

In this reagrd read the vary carefully the notification 30/2012 and try to understand. If you canot received any fruitfull result in this regard then you forward the same.

  

I want to knw if the service provider is also a registered body or corporate then will he charge Service tax in his bills where that service is convered under RCM like GTA service provided by a Pvt Company.

The rules of RCM differ from service to service.

In case of GTA service, the status of the service provider is not at all relevant. RCM is applicable if the person liable to pay freight (may be consignor or consignee) is a specified person like partnership firm, body corporate, co-operative society, factory, registered dealer under central excise, etc. 

In case of insurance services provided by insurance agents to the insurance companies, RCM is applicbale in all cases.

In case of security service, manpower service, works contract and rent a cab service, RCM is not applicable if the service provider is a company.

Thanx Manoj sir One of my client is a pvt ltd company providing GTA services and is charging Service Tax in its bill at abatement rates. kindly tell me are they correct in charging Stax in their bills or they should avoid charging Service tax in their bills????

They do work for big companies like moserbear Havells etc for trasporting their goods by road with consignment note then they bill their customer by charging Service tax on it.. is it ryt practise? As per me they should not charge it in their bills

Prima Facie, it seems your client is not required to charge service tax

Yes sir they provide consignment note with details of Consigner and Consignee with frieght amount to be paid or paid by the consigner or consignee and material descripttion is also mentioned on it.. then they issue their original bill to their party with service tax..
