RCM Payable on Royalty charges payable on lease permit

Dear Sir, My client is engaged in mining business. Business is quarry ( Natural Minerals ). My client has only permit for mining and but he is not leassee of the that mining. He has paid Royalty for mining so he is liable to pay RCM on Royalty?
