RCM and its rate of GST

Rate / HSN codes 770 views 6 replies
We are a registered dealer getting supply of goods and services from URD. Services like tea, printing & stationery etc.

Now I'm clear that GST need to be
paid under RCM.

Now my question is at what rate (does the rate of tax which is applicable to tea, stationery items)? Do I need to raise any invoice for the same?

Expert views please.

we purchased some goods, but the goods will accepted in factory gate after necessary quality testing. here seller & buyer both r registered under GST. Sellers invoice is also of GST. But now for quality rejection the same vehicle going to return to seller without unloading into the factory. Even no inward entry GRN or Accounting entry made for the same.
So my query is that, in such situation whether any fresh bill required from our(buyer side for goods rejection) or only rejection note given on letterhead(as given in earlier law) is sufficient.

@ Vijay Kumar:  Whenever the expenditures exceeds Rs. 5000/- on any particular day....... then RCM is applicable at the rate specified over the supply ( in mixed supply..... maximum rate)

Till such sundry expenses do not exceed Rs. 5000/- (in aggregate) on any day....... No need to pay GST under RCM.

Self billing of the expenditure to be reported in GSTR 1.

@ Shivkumar Alli: Yes, at present same system works, unless any further notification......

if I purchase worth rs 3000 and booked on Dated 21jul from URD so rcm is not applicable but after one month or two month later on I found one back dated invoice on dated 21jul of rs 2500 then in this case we have not deposited the rcm but value booked above 5000

Dear dhirajlalji,

1. suppose amount exceed Rs. 5000/- and total expenses in one day is 15000/-, which amount to be payable for GST - (15000-5000) - 10000/- or direct to 15000/- ?

2. suppose expenses is differnt ie stationery item, tea, travelling exp. in one day above 5000/-, what gst rate to be applicable?

1. total amount.... here it is 15K

2. As per item/supply rate specified in schedule............ need not be all mixed supply.
