Query on rate of duty applicable

I have a querry on central excise.

As per SECTION 3, THE charging section.  Excise duty is applicable on exciseable goods and the rate is that applicable at the time of removal of goods.

Say on 15th Feb   a company has manufactured goods to the value of INR 8,50,000.00 and the rate applicable then is 10% . Later on 30th March ,s goods worth INR 200,000/- is removed from the warehouse where the goods are stored and the rate of tax prevalent is 12%.  The balance goods worth INR 6,50,000/- is removed in two lots dated 15th April and 30th April. The balance sheet of the company is finalised on 15th May 2012.

What would be the rate applicable 10% or 12%

In balance sheet on 31st March, the provision for excise duty payable will be on INR 200,000/- or ON 8,50,000.00

Rate applicable is 12% and Provision will on Rs.850000

Dayanand.. ru sure . as the rate applicable is on the date of removal , then the amount payable should also be the amount for the goods that has been removed as on 31st March..

point and date of clearance is not the factory gate, but the godown / depot of assesee, so the assasable value and rate of tax prevailing on the date of clearance from such depot/godown is applicable.
