Memorandum of my company is having 4 clauses:-

Telecom Infrastructure

Builders

Traders- Both Retail and wholesale

Manufacturers

Now the company is contemplating to bring FDI for telecom infrastructure, however the FDI limits are not uniform for the above mentioned sectors. Now,

1. Can the company bring FDI and use it for telecom Infrastructure and maintain proper records of end use of the funds

2. Should the company accept the extent of least of FDI limit for the above mentioned sector

3. The company amend MOA and include only one clause "Telecom Infrastructure" and then get FDI

1. Can the company bring FDI and use it for telecom Infrastructure and maintain proper records of end use of the funds YES

2. Should the company accept the extent of least of FDI limit for the above mentioned sector You can accept to the extent as provided for Telecom Sector

3. The company amend MOA and include only one clause "Telecom Infrastructure" and then get FDI. If you can do so, thats best option.
