Provident Fund of labour contractors

Dear Friends

Ours is a pvt limited company having over 200 emplyees, we engage labour contractors to work in our assembly section.

one of our labour contractor having only two colleagues/sub-ordinates/employees who work in our factory and bills us for the same

is it mandatory/obligatory for us to see/verify whether he pays PF dues in respect of his two employees/colleagues ??

since he do not come under the def of an "Establishment" under PF Act 

Pl help and guide me for material to substantiate

hi milind,

for your side it is basic requirement to check whether contract is paying to PF office or not.

hence you have right to stop his bills until he show the P F challan to you or your boss you should not release the payrment
